Family Law Proceedings – Can I protect my inheritance?

If you have received an inheritance prior to separation then it will generally be included in the asset pool as the court looks at the assets at the time the matter comes before the court. There are of course exceptions to this, for example if you have received your inheritance in the form of a testamentary trust you may be able to exclude this from the asset pool.

Can I get a costs order?

Generally if you and your former partner are involved in a family law dispute you will both be required to pay your own legal costs. However this is not a blanket rule and in some cases you may be able to apply to the court for one party to pay the legal costs of the other party (known as party-party costs). You can talk to your solicitor about options involving costs.
